The conditions are subject to modification. The conditions applicable to your order will be those in force on the Website at the time you place the order. Article 1: Object These conditions define the rights and obligations of the vendor and the purchaser. If you do not agree to be bound by these conditions you may not use or access this Website. The company Alice L. Sylvie LETE trades under French law. These terms and conditions have been translated from those set out on the French language pages of the Website under the title ‘Conditions Générales de Vente’. Should there exist any discrepancy of meaning, then the meaning expressed on the French pages shall apply.
Article 2: Applicability These terms and conditions apply only to those orders placed using this Website. An order will be accepted by the vendor, only after the purchaser has accepted these conditions. Article 3: Eligibility To place an order you must be aged at least 18 and not have been declared bankrupt nor be undergoing bankruptcy proceedings. Article 4: Placing an order Orders must be placed using the Website. The contractual Information concerning the order should be confirmed by the purchaser no later than the date of delivery. Placing an order implies acceptance by the purchaser of these conditions. Offers made on this Website by the vendor are limited to the number of items available. Before placing the order the purchaser must furnish the vendor with the necessary details to process the order. Complete the on-line registration form under the section ‘My Account’. The contract between vendor and purchaser is established when the purchaser clicks on the ‘Confirm’ button. We reserve the right to cancel or refuse an order from a client, who has an outstanding payment in dispute. Article 5: Prices The prices of our products are quoted in euros with VAT (value added tax) included. They do not include postage, packing and processing charges. We reserve the right to change prices at any time. The price invoiced will be that in force at the time the order is placed. All products remain the property of Alice L. Sylvie LETE until payment has been fully completed. Article 6: Availability For every order placed, you will receive an e-mail. This e-mail will confirm that your order is being processed and does not confirm that the products are available. If something is missing from the delivery please inform us. Article 7: Delivery The products are delivered to the address you have given us when placing the order. The delivery times quoted are those on average for processing of the order and transport. In case of non reception of the packet by the customer for a bad delivery adress or for any others cases, the return postage cost will be requested in the amount of post charges in place for the shipment of the current packet and the new shipment cost will be ask too. We take no responsibility for delays in delivery on the part of carrier, especially through loss or strikes. Article 8 :Payment Payment must be made by debit or credit card issued by CB, Visa or Mastercard. Debit cards will be charged within 3 banking days of the shipment and credit cards according to the operator. Payment by bank card cannot be cancelled. The payment is irrevocable without prejudice to the purchaser’s rights to cancel the order. The product does not become the property of the purchaser until payment has been fully completed before shipment. Article 9: Right of cancellation On receipt of the product, the purchaser has a right to return it within 10 days, without having to give a reason. If the purchaser exercises this right within 10 calendar days, the vendor agrees to reimburse the purchaser within 30 days of the right being exercised. The refund will be a refund on his bank card or by cheque. Refund will be made only for products which are complete, in their intact original packing, and are in perfect condition for resale. Any article which has been damaged or whose original packaging has been spoilt will be neither exchanged nor reimbursed. The return postage costs are at the expense of the purchaser. To exercise this right, the purchaser must use the ‘Contact’ button on the Website. A confirmation acknowledging this request will be sent to him by electronic mail. Article 10: Conformity of goods The purchaser has the benefit of a guarantee against hidden defects as provided by Article 1641 of French Civil Law. If an item received by the purchaser does not conform to that which he ordered it will be replaced or repaired according to his wishes, except where the cost would be out of proportion with its value. The claim must be made within 10 working days of receiving the order. Any claims after this period will not be accepted. The cost of the return is at your expense. Article 11: Refunds Products sold in "Pleasure and Well-being" are neither resumed nor changed. Refunds on goods will be made no more than 30 days after we receive the goods. Refunds will be a credit on your bank account. No other refund can be made. Article 12: Responsibility The responsibility of the vendor is limited to damage arising directly from the use of the Website or goods delivered. The vendor will not be responsible if the failure to fulfil these obligations is attributable to the purchaser, to an unforeseeable and insurmountable action by a third party or external force. The vendor will not accept responsibility for damage resulting from misuse of the products. The responsibility of Alice L. Sylvie LETE, in all circumstances, is limited to the value of the order, and cannot be invoked for simple errors and omissions which exist despite the precautions taken in the presentation of the products. Article 13: Intellectual Property All elements of the Website, such as sounds, images, photographs, videos, programme, animation, graphs, data, and software are protected by Intellectual Property Law, worldwide. They are the property of Alice L. Sylvie LETE. In conformity with the Intellectual Property Law, private use is permitted, with severe restrictions. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. The vendor takes it upon himself to take the necessary precautions to preserve the integrity of the information and to protect it from third parties. Article 15: Partial Invalidity of these Conditions If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions. Article 16: The Law These conditions are subject to French law. Article 17: Dispute In the case of a dispute concerning these conditions, the parties involved will attempt to reach a compromise.
